Mediation is a voluntary, private, informal and structured out-of-court dispute resolution process, where two or more people called the disputing parties agree to communicate and negotiate with one another in good faith facilitated by a third party called a mediator. The role of the mediator is to encourage and assist the parties to generate their own amicable outcome or solution/s to their dispute.
It generally depends on the amount of money Claimed or Counterclaimed, as well as the complexity of the case.
Anyone involved in civil and commercial dispute can submit their dispute to mediation.
No, you don’t have to hire a solicitor to use mediation. The disputing parties can agree to directly engage a mediator themselves.
